Community Health Network, Inc. (“Community”) is pleased to offer you access to MyChart. Community offers MyChart access to you conditioned on your acceptance of these terms and conditions, which shall govern your use of the MyChart services and system. By clicking on "Accept", you accept without modification all of these MyChart Access Terms and Conditions contained herein (“Terms and Conditions”) and acknowledge and agree that these Terms and Conditions are a binding agreement between you and Community. If you do not agree to these Terms and Conditions, you must decline them and not use MyChart.
In consideration of your agreement to these Terms and Conditions and for other valuable consideration, Community grants to you a nonexclusive, nontransferable, limited, terminable license to access and use MyChart only in the United States. Community reserves all rights not expressly granted in this agreement.
To improve our ability to serve you, Community may make modifications, improvements, deletions, or amendments to the MyChart system at any time we deem appropriate. Any and all relevant portions of this agreement will apply automatically to all modifications, improvements, deletions, and/or amendments as they appear.
What is MyChart?
MyChart is a communication service offered as a convenience to Community patients. It is an Internet application that enables patients to have web-based access to portions of their Community electronic medical record, and allows a convenient communication channel with certain Community providers for non-urgent messages. Use of this service is optional and no fee will be charged to use it. MyChart is NOT for medical emergencies – for emergencies, please contact your physician’s office by phone, go to an emergency room, or dial 911.
You understand that MyChart provides online access to portions of your Community medical record and that you are solely responsible for any sharing of its content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate department as necessary for handling, and therefore, Community employees, other than your healthcare provider may be involved in addressing your request. Therefore, use of MyChart may, in your mind, not be appropriate for very sensitive information you wish to discuss directly with your provider. In such circumstances where you desire to only share such information with your healthcare provider, it is your sole responsibility to ensure such information is not included in your messages being sent through MyChart. Electronic messages sent by you and responses from health care providers will be retained in the MyChart system.
Users Must Be 18 Years of Age
MyChart is available only to individuals over the age of 18. By applying for access to MyChart you represent that you are not under the age of 18. In addition, you agree to be responsible for (a) prohibiting use and/or access to your MyChart account by those under the age of 18; and (b) limiting access to your computer or the Internet to the extent necessary to restrict access to MyChart to those over the age of 18. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section below.
Individuals age 18 or older may request proxy access to another individual’s MyChart account by completing a Proxy Access Form and submitting it to Community. Such access will only be granted to individuals with parental rights or legal rights over the MyChart patient/account holder and only to the extent that the individual requesting proxy access can demonstrate the legal right to the account holder’s medical information. Full MyChart proxy access is available for children up to age 14 but limited between the ages of 14 and 17. A MyChart account will be activated for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes, the proxy must inform Community immediately by calling the MyChart Support line at (317) 355-2273. Community reserves the right to revoke proxy access at any time for any reason.
Services and Responses
Community will use reasonable efforts to provide a timely response to electronic messages. While the anticipated turnaround time is two (2) business days during normal office hours, this is only an estimate and not a binding a commitment. Thus, if you determine a more urgent response is necessary, it is your responsibility to follow up and/or schedule an appointment if warranted.

Community will, at all times, use reasonable efforts to maintain the confidentiality of your confidential medical information and will not disclose any such information to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records. When you initially enroll in MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called “MyChart ID”) and a password. Once this access code has been used it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. Your password is only known by you and can be changed online at any time by you. Your password is not known by anyone at Community. It is recommended that you change your password every 180 days.
You will be notified via e-mail when there is new information to be viewed on MyChart account. Therefore, this means that any person with access to your e-mail will be able to see this notification; this could include your spouse, employer or anyone else that can access your e-mail account. Although no private medical information will be sent via e-mail, the notification that new medical information is available by accessing MyChart may be information that you would not want others to know. Thus, you should take into account who has access to your e-mail address when providing an e-mail address for such notices to be sent.
Firewalls, passwords, encryption and other periodic quality oversight activities are used to safeguard your information and the communications between you and Community through MyChart (the "Security Measures"). While such Security Measures are used, you agree that Community shall not be liable for the failure of such Security Measures unless such failure is due to Community's gross negligence or willful misconduct.
Access to MyChart is granted to users for their convenience and to share information related to their medical care. Your use of the system unrelated to this purpose may result in the suspension or termination of your access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled and other activities that are deemed to cause a disruption to clinic operations in the sole discretion of Community.
You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Community has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Community has the right to suspend or terminate your account and refuse any and all current or future use of the MyChart services (or any portion thereof).
If your use of MyChart violates these Terms and Conditions, Community reserves the right to permanently terminate access to MyChart.
You can disenroll from your use of MyChart at any time by calling the MyChart Support Line at (317) 355-2273.
With respect to any electronic communications you send, your health care provider is only able to respond to such communications based on the information you have provided. If there is insufficient information provided or an appointment is needed, your health care provider will be unable to provide accurate and reliable services through MyChart.
Community assumes no responsibility for how you use the information you obtain from MyChart. You should consult with a physician or other health care provider regarding your own condition and how the information in MyChart applies to you. MyChart access is not a substitute for consultation with your physician and MyChart does not include your entire medical record. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.
Community may restrict or terminate access to MyChart at any time, including, but not limited to times, where maintenance of the MyChart system is needed or you have violated these Terms and Conditions. Access is provided on an "as is available" basis and you agree that access is not guaranteed at any particular time. You agree that Community shall not be liable to you for any modification, suspension or discontinuance of the MyChart services (or any part thereof).
You agree to hold harmless Community should any information be lost while communicating online or if any information is disclosed to any other individual communicating with Community using your MyChart account.
THE MYCHART SERVICES AND SYSTEM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMMUNITY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. COMMUNITY MAKES NO WARRANTY OR REPRESENTATION THAT (a) THE MYCHART SERVICES OR SYSTEM WILL MEET YOUR REQUIREMENTS; OR (b) THE MYCHART SERVICES OR SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT COMMUNITY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR OTHER INTANGIBLE LOSSES (EVEN IF COMMUNITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE MYCHART SERVICES AND SYSTEM; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OF DATA THROUGH THE MYCHART SERVICES AND SYSTEM DUE TO NO FAULT OF COMMUNITY; OR (iii) STATEMENTS MADE BY, CONDUCT OF, OR ANY INFORMATION, SERVICES OR GOODS PROVIDED BY A THIRD PARTY.

Community, through MyChart, may provide, or third parties may provide, links to other World Wide Web sites or resources. You acknowledge and agree that Community is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Community shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana without regard to its conflict of law provisions and any dispute, claims or causes of action (regardless of theory) arising out of or relating to these Terms of Conditions or the relationship between you and Community shall be exclusively brought and exclusively maintained in a federal or state court with competent jurisdiction in Indianapolis, Indiana. You and Community agree to submit to the personal jurisdiction of courts located within Indianapolis, Indiana and agree to waive any and all objection to the exercise of jurisdiction over the parties by such courts and to venue in such courts.
These Terms and Conditions constitute the entire agreement between you and Community and govern your use of the MyChart services. The failure of Community to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.
These Terms and Conditions are effective until terminated by either you or Community. Community may terminate these Terms and Conditions, with or without advance notice.
BY USING MYCHART AND CLICKING ON ACCEPT, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND REPRESENT THAT YOU HAVE READ AND UNDERSTOOD ALL OF THESE TERMS AND CONDITIONS.
